A weekly market is a regularly recurring, temporary event at which several traders are allowed to offer certain groups of goods. If you want to organise a weekly market, you need the approval of the competent authority.
With the approval, you as the organiser are allowed to hold the weekly market and are obliged to do so.
the municipal or town council of the place where the market is to be held
Note: In addition, other goods for daily use may possibly be admitted, e.g. household goods. Further details are regulated in the respective market regulations of the municipality.
You must apply for the determination.
As a rule, an informal application with the following information is sufficient:
Some administrative authorities offer a form for this purpose or make it available online for download.
As soon as the weekly market has been established, you will receive written notification.
Attention: The establishment of the weekly market obliges you as the organiser to hold it.
The competent authority may impose conditions on the market, e.g. for the protection of participants. Conditions can also be added, changed or supplemented at a later date.
Submit the application at least six weeks before the start of the event. If there is a public market announcement, you will find the application deadline there.
When checking your personal reliability, the competent body may, in individual cases, request further documents in addition to those listed which are suitable for making a statement about your personal reliability.
In the case of legal entities (GmbH, Unternehmensgesellschaften, AG, eingetragene Genossenschaften), the application form is to be completed only for the legal entity itself. All personal documents must be submitted for all natural persons authorised to manage the company, e.g. certificate of good conduct, personal papers. For the legal entity, an extract from the Central Trade Register must also be applied for.
In the case of partnerships that are not themselves eligible for a permit (GbR, KG, OHG, PartG, GmbH & Co. KG), each managing partner requires the permit, so that an application form and all personal documents are necessary for each one.
Note: The authority may request further documents, e.g. a tax clearance certificate.
The amount of the fees is determined by the municipal fee statutes.
As the organiser, however, you can restrict the weekly market to certain groups of suppliers or visitors or exclude individual interested parties. The selection among the applicants must be made according to objective, verifiable selection criteria. Further information on this topic can be found in the procedural description"Admission to fairs, exhibitions, wholesale markets, weekly markets, special markets and funfairs".
