Immission control - Submit measurement report on individual measurements of air pollutants at installations using organic solvents in accordance with 31 BImSchV

If you are the operator of a system in which volatile organic solvents (VOC) are used, you must have the solvent emissions checked regularly by means of individual measurements under certain conditions.

The measurements must be carried out by a notified body (measuring centre) in accordance with Section 29b of the Federal Immission Control Act.

You must immediately draw up a measurement report on the results of the measurements and, if the installation does not require a licence, keep it on site for 5 years. You must submit the measurement report at the request of the responsible immission control authority. Measurement reports on emission measurements in installations requiring authorisation must be submitted to the responsible immission control authority no later than 12 weeks after completion of the measurements.

Responsible authority

The responsibilities in the area of immission control are regulated in the Immission Control Competence Ordinance of the state of Baden-Württemberg.

In most cases, the competent authority for plants that fall under the 31st BImSchV is the local lower immission control authority, i.e

  • the district office if the premises with the plant are located in a district,
  • the city administration if the premises with the plant are located in a city district.

A different responsibility applies in the following cases (e.g. for companies that are subject to the European Industrial Emissions Directive, the Hazardous Incident Ordinance or mining law):

Departments 5, Environment of the respective locally responsible regional councils are the competent immission control authorities for company premises on which

  • at least one installation marked with the letter E in column d of Annex 1 of the Ordinance on Installations Requiring a Licence,
  • at least one operating area in accordance with Section 3 (5a) of the Federal Immission Control Act (hazardous incident operation),
  • at least one installation that requires a licence pursuant to Section 60 (3) sentence 1 no. 2 or no. 3 of the Federal Water Act, or
  • at least one landfill in accordance with Article 10 in conjunction with Annex I of Directive 2010/75/EU of the European Parliament and of the Council of 24 November 2010 on industrial emissions (integrated pollution prevention and control), as amended

exists or is to be constructed.

Department 9, State Office for Geology, Raw Materials and Mining of the Freiburg Regional Council is also the state-wide competent immission control authority for

  • Operational sites, including the facilities and activities located on them, which are subject to mining supervision,
  • Operating sites with cable cars and funicular railways used for passenger transport,
  • Sites with high-pressure gas pipelines which, as energy installations within the meaning of the Energy Industry Act, serve to supply gas and which are designed for a maximum permissible operating pressure of more than 16 bar,
  • Underground waste disposal facilities and
  • Sites with installations used for the construction, significant expansion and significant modification of underground cavities.

Prerequisite

  • You are the operator of a plant in which volatile organic solvents (VOC) are used.
  • You carry out one of the activities listed in Annex II of the Solvent Ordinance.
  • Your solvent consumption is above the threshold value according to Annex I of the 31st BImSchV.

Procedure

  • Firstly, check whether individual measurements must be carried out at your installation in accordance with the requirements of the 31st BImSchV.
  • If so, then contact a notified body (measuring centre) in accordance with Section 29b of the Federal Immission Control Act.
  • The measuring centre will determine the emission values on the measurement date.
  • You must immediately draw up a measurement report on the measurement results or have one drawn up.
  • In the case of installations not subject to authorisation, the measurement report must be kept at the operating site for 5 years and submitted to the immission control authority on request.
  • In the case of installations requiring authorisation, the measurement report must be submitted to the immission control authority no later than 12 weeks after the measurement.

Deadlines

If you have newly installed or significantly modified your system, you must have the first measurement carried out within 3 to 6 months of commissioning. Subsequently, the measurement must be carried out every 3 years.

If your installation requires a licence, you must submit the measurement report to your local immission control authority no later than 12 weeks after the measurements have been completed.

Complete measurement report in accordance with Annex A of Guideline VDI 4220 Sheet 2 (November 2018 edition) with information on, among other things

  • Measurement results,
  • measurement methods used,
  • Operating conditions that are important for the assessment of the measurement results.
